This commitment includes training managers/supervisors and employees regarding their rights and responsibilities under this equality, diversity and inclusion policy.

Responsibilities, include staff conducting themselves, in a manner to promote equal opportunities in the workplace, prevention of bullying, harassment, victimisation and unlawful discrimination.

All staff have a responsibility in such matters and can be held liable for acts of bullying, harassment, victimisation and unlawful discrimination, in the course of their employment, against colleagues, clients, suppliers and members of the public.

The Board will treat complaints of bullying, harassment, victimisation and unlawful discrimination by employees, clients, suppliers, visitors, seriously, and any investigation will be conducted in a manner commensurate to the nature of the complaint. Such acts will be dealt with as misconduct under Bio Drives Grievance(HR002) and Disciplinary procedures (HR003), and appropriate action will be taken.

Serious complaints could amount to gross misconduct and lead to dismissal without notice – see Bio-DriveHR003 para 13. Use of the Bio-Drive Grievance or Disciplinary procedures does not affect an employee’s right to make a claim to an employment tribunal within three months of the alleged discrimination.

Furthermore, sexual harassment may amount to both an internal disciplinary issue and a criminal matter. In addition, harassment under the Protection from Harassment Act 1997 – which is not limited to circumstances where harassment relates to a “protected characteristic”, as detailed in the Equality Act 2010– is a criminal offence.

Decisions, concerning staff will be based on merit (apart from in any necessary and limited exemptions and exceptions allowed under the Equality Act 2010).
